Elden Preloved Market – Seller Terms & Conditions

1. Lost, Stolen, or Damaged Items

While Elden & Co LLC takes reasonable measures to organize, monitor, and protect inventory through staff oversight and security systems, we are not responsible for any lost, stolen, or damaged items.

By participating, Sellers acknowledge and accept this risk.

2. All Sales Are Final

All purchases made in-store are final. No returns or exchanges are permitted.

3. Booking & Payments

All booth reservations must be paid in full at the time of booking to secure the Seller’s space.

Bookings are not confirmed until full payment is successfully processed.

All booth rental payments are non-refundable.

Cancellations & Rescheduling: Sellers may reschedule their booking one time if requested at least 48 hours prior to their scheduled start date.

No Show Policy: Failure to arrive for a scheduled booking will result in forfeiture of the booth reservation and all associated fees.

No refunds will be issued for cancellations, no-shows, or unused booth time.

4. Booth Assignment Policy

Booth spaces are assigned at the sole discretion of Elden management. Booth placement is determined to maintain an organized, balanced, and high-performing sales floor. Specific booth locations are not guaranteed and not selectable at the time of booking. Elden reserves the right to reassign booth locations at any time to support store operations and overall performance.

5. Commission Structure

  • Seller receives: 60%

  • Elden & Co LLC retains: 40%

All fees (including processing fees) are applied before payout distribution.

6. Payouts & Financial Information

Payouts are issued within 3–7 business days following the Seller’s final sale and are processed via approved methods (e.g., Venmo or Seller Portal ACH).

Sellers are responsible for providing accurate payment information. Elden & Co LLC is not responsible for payments sent to incorrect accounts due to inaccurate or outdated information.

Elden & Co LLC does not store bank account or ACH information. All payment details must be submitted through the secure Seller Portal or approved third-party processors. Elden & Co LLC will never request banking information via email, text message, or informal communication channels.

7. Unsold Inventory

  • All unsold items must be picked up within 48 hours of the end of the Seller’s rental period.

  • Items not picked up may:

    • Be donated

    • Be resold

    • Become property of Elden & Co LLC after 7 days

  • A $10 handling fee may be deducted from final payout for uncollected items.

8. Cancellations & Rescheduling

  • Sellers may reschedule their booking one time if done at least 48 hours prior to start date.

  • No refunds are issued for booth/space rentals under any circumstance.

9. Discounts & Promotions

Elden & Co LLC reserves the right to run storewide promotions or discounts at any time.

  • Discounts apply to the total sale price, not just Elden & Co’s portion.

  • These promotions are intended to increase traffic and overall Seller earnings.

10. Item Standards & Authenticity

  • Sellers must ensure all items are:

    • Clean

    • In good condition

    • Accurately represented

  • No counterfeit items permitted.

  • Designer items must be authentic; disclosure is required.

  • Elden & Co LLC reserves the right to remove any item at its discretion.

11. Store Authority & Management Discretion

Elden & Co LLC reserves the right to:

  • Refuse or remove inventory

  • Reorganize displays

  • Adjust floor placement

  • Enforce store standards

No compensation will be provided for removed items due to policy violations.

12. Marketing & Promotion

By participating, Sellers grant Elden & Co LLC permission to:

  • Photograph items

  • Use images/videos for marketing

  • Promote inventory via social media, website, and advertising channels

13. Chargeback & Payment Disputes

By completing a booking, the Seller acknowledges and agrees that all booth rental payments are final and non-refundable.

Sellers agree not to initiate chargebacks or payment disputes for services rendered or reserved. In the event of a chargeback or dispute, Elden & Co LLC reserves the right to provide proof of agreement, including accepted Terms & Conditions, booking confirmations, and payment records.

If a chargeback is filed without valid cause, Elden & Co LLC reserves the right to:

  • Deny future bookings

  • Recover associated fees

  • Pursue collection of unpaid balances if applicable

14. Mobile Messaging

By opting into services, you agree to receive recurring automated marketing and informational text messages.

Message frequency may vary. Standard message and data rates may apply.

Consent to receive messages is not required for purchase.

You may opt out at any time by texting STOP, or request assistance by texting HELP.

Carriers are not responsible for delayed or undelivered messages.

15. Privacy & Data Usage

  • Mobile opt-in data will not be shared with third parties

  • Sellers must notify Elden & Co LLC if their phone number changes

  • Continued use of services implies consent to data practices

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia.

17. Entire Agreement

These Terms constitute the full agreement between the Seller and Elden & Co LLC.

No other agreements are valid unless in writing and signed.

18. Modifications

Elden & Co LLC reserves the right to update these Terms at any time.

Continued participation constitutes acceptance of any changes.

19. Acknowledgment

By participating as a Seller with Elden & Co LLC, you confirm that you have:
